Today, the management measures jointly issued by six ministries and commissions are the key measures to maintain the stable development of bike sharing industry, and also an important step to push the industry forward.
On May 16, the Ministry of transport, the people's Bank of China, the national development and Reform Commission, the Ministry of public security, the General Administration of market supervision and the China Banking and Insurance Regulatory Commission jointly issued the measures for the management of user funds in new forms of transportation (Trial) (jytg [2019] No. 5, hereinafter referred to as the measures).
According to the Ministry of transport, the promulgation of the "management measures" is of positive significance for preventing users' financial risks from the source, strengthening the protection of users' rights and interests, and promoting the healthy and stable development of new transport formats. There are 5 chapters and 27 articles in the administrative measures, which make specific provisions on the collection of users' funds, the opening of special deposit accounts for custody, the establishment of joint working mechanism and the strengthening of supervision.
For the collection of users' funds, the administrative measures proposes that in principle, operating enterprises do not collect users' deposits, and if it is necessary to collect them, they should provide two ways for users to choose: operating enterprises' special deposit accounts and users' personal bank settlement accounts. The user's deposit shall be owned by the user, and the operation enterprise shall not misappropriate it.
Moreover, the administrative measures also limit the upper limit of deposit and the refund cycle.
According to the administrative measures, the amount of a single deposit for renting bicycles on the Internet shall not exceed 10% of the average cost price of bicycles put into operation by the operating enterprises. The operating enterprise shall specify the amount of deposit collected and the conditions for deduction of deposit in the service agreement signed with the user, and clearly indicate the deposit return method, procedure and cycle in a prominent position on the network platform.
The "administrative measures" also clearly states that the longest refund period for the deposit of time-sharing car rental users should not exceed 15 working days, and the longest refund period for the deposit of Internet rental bicycle users should not exceed 2 working days.
