14 cities have implemented one-child care leave list of one-child care leave all over the country

As of March 22, at least 14 provinces across the country have implemented the relevant policy of "one-child care leave", and four other provinces have also put forward relevant suggestions for "one-child care leave". So for the only child, there is time to go home to take care of their parents.

14 to introduce 'only child care leave' related policies

The "one-child care leave" refers to the leave that should be given by the employer during the period when the parents of the one-child are sick and hospitalized, and the salary, allowance, bonus and other benefits during the accompanying period shall not be deducted.

According to the data, by the end of 2018, there were 249 million people aged 60 and above in China, accounting for 17.9% of the total population. The pension problem of one-child families is gradually emerging. In order to help one-child families lighten their burden, local governments have successively issued relevant policies such as "one-child care leave" in recent years.

According to the incomplete statistics of Zhongxin Jingwei client, as of March 22, 2019, at least 12 provinces including Fujian, Guangxi, Hainan, Hubei, Heilongjiang, Chongqing, Sichuan, Hebei, Henan, Ningxia, Inner Mongolia and Shanxi, as well as two cities including Huai'an and Guangzhou, have issued specific regulations related to "only child care leave".

Among the 14 places mentioned above, Hubei, Heilongjiang, Sichuan, Ningxia and other four provinces also stipulate that non only child can also enjoy the treatment of 'nursing leave'. For example, the regulations of Sichuan Province on the protection of the rights and interests of the elderly (Revised) implemented on October 1, 2018 stipulates that if the elderly cannot take care of themselves during hospitalization, the employing unit where their children are located should give the only child no more than 15 days of nursing care per year, and the non only child no more than 7 days of nursing care per year. During the period of nursing care, the wages and benefits remained unchanged.

The specific time limit for 'nursing leave' varies from place to place. During the implementation of the "one-child family planning policy" in Huaian City, for example, the nursing unit with less than 60 days of sick children should be defined. The regulations of Henan Province on the protection of the rights and interests of the elderly points out that during the hospitalization period of the elderly receiving the honor certificate of the parents of the only child, the unit where their children belong should give them at least 20 days of nursing leave each year. However, Hebei Province does not specify the number of days of nursing leave. The regulations on the protection of the rights and interests of the elderly in Hebei Province only requires that the unit where the children are in should support the elderly to take care of them and give them appropriate time to accompany them.

The relevant policies of four provinces are on the way

Liaoning, Gansu, Yunnan, Beijing and other four provinces have not yet issued specific provisions on "one-child care leave", but also proposed to explore the establishment of one-child care leave system.

Among them, Yunnan Province issued an announcement in May 2018 to solicit opinions on the regulations of Yunnan Province on the protection of the rights and interests of the elderly (Revised Draft). The draft mentions that during the hospitalization of the elderly in one-child families, the employing units of their children should support nursing care, and provide no more than 15 days of nursing time per year, and enjoy the same salary as during normal work.

In the opinions of the general office of Liaoning Provincial People's Government on the development and implementation of elderly care services in Liaoning Province issued in 2018, Liaoning Province mentioned that all regions should formulate family support policies such as paid accompanying leave for sick parents, so as to guide citizens to consciously fulfill their support obligations and take care of the elderly.

In February 2018, Gansu Provincial Health and Family Planning Commission held a video conference on the work of population and family planning in the new era and the initiation of the investigation on the situation of poverty-stricken people returning to poverty due to illness. At the meeting, it was proposed to coordinate the development of the system of nursing leave for parents of one-child families.

In October of the same year, Beijing issued the implementation opinions on strengthening care services for the elderly and improving the pension system, which clearly explored the establishment of family care leave system. The employer shall give corresponding nursing leave to the caregivers, especially the one-child caregivers and caregivers who take care of the sick, hospitalized, disabled, mentally retarded and dying elderly, and the salary, allowance, subsidy and bonus during the nursing period shall not be deducted.

More provinces are encouraged to explore

Previously, the Ministry of human resources and social security pointed out in its reply to proposal No. 6205 of the first session of the 13th National People's Congress that the establishment of "one-child care leave" is conducive to coping with the aging society, enhancing the ability of one-child family to provide for the aged, and better protecting the legitimate rights and interests of the elderly. The Ministry of human resources and social security said that in the next step, it will combine the level of economic and social development, comprehensively consider the impact of holiday increase on enterprise labor costs and other factors, actively cooperate with the health and other departments to conduct in-depth research and demonstration, widely listen to the opinions of all parties, and actively put forward opinions and suggestions to the legislature.

Subsequently, on December 28, 2018, in its reply to recommendation No. 4477 of the first session of the 13th National People's Congress, the National Health Commission mentioned that it would coordinate with the Ministry of human resources and social security to encourage and support more provinces to explore the implementation of the 'one-child care leave' system, so as to make this system benefit more and more one-child families.

Gao Li, Secretary of the Party group of Anhui disabled people's Federation, suggested that relevant policies should be formulated from the national level to stipulate that the regulations on the care and accompanying leave of only child should be included in the legislative plan, and the corresponding safeguard measures and legal responsibilities should be made clear, so as to ensure the operability of the regulations.

Shi Weidong, President of Nantong University, also proposed that the state should introduce a "one-child care leave" policy. He said that although some provinces have begun to explore the practice, the time, content and strength of each place are different, so it is not universal. The country should promote it nationwide on the basis of summing up local experience.
