Before we can solve this problem, we need to have a correct understanding of Laolai.
Laolai is also called the executor of the breach of credit. Although it is possible to become Laolai if the credit card is overdue, it is not certain. Only those who are sued by the bank and have the ability to repay but refuse to implement after the expiration of the time limit can be included in the list of those who are dishonest and executed and become old rascals.
So, how long a credit card is overdue has nothing to do with being a veteran.
Because overdue is only a loan dispute between you and the bank. Without being sued by the bank and judged by the court, it is not a Laolai from the point of overdue alone. No one has the right because overdue slanders you.
Unless you have been overdue for 3 months, and after the bank's two effective collections fail, you are sued by the bank, and you fail to repay before the court's judgment, and you are able to repay after the judgment but refuse to execute, you will become a Laolai. However, it is also possible that the bank will eventually sue you to the court, but you are really unable to repay, and the court will not consider you a Laolai.
But it should be noted that no matter how long your credit card is overdue, if malicious overdraft constitutes a crime of credit card fraud, it will be legal sanctions waiting for you.
According to the relevant provisions of China's criminal law, the malicious overdraft of credit card with an amount of more than 50000 yuan but less than 500000 yuan shall be recognized as "relatively large amount" in Article 196 of the criminal law, and shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention and shall also be fined not less than 20000 yuan but not more than 200000 yuan.
