Article 95 If a motor vehicle travelling on the road fails to hang a motor vehicle number plate, place an inspection mark or an insurance mark, or carry a driving license or driving license with the vehicle, the traffic administrative department of the public security organ shall detain the motor vehicle, notify the party concerned to provide the corresponding license plate or mark or go through the corresponding formalities, and may impose a penalty in accordance with the provisions of Article 90 of this law. How to punish unlicensed driving?
A fine of not less than 200 yuan but not more than 2000 yuan shall be imposed for driving a motor vehicle during the period when the road traffic safety law of the people's Republic of China has not obtained a motor vehicle driving license, the motor vehicle driving license has been revoked or the motor vehicle driving license has been temporarily withheld, and may also be detained for not more than 15 days.
1、 Unlicensed driving can be divided into the following situations (one of them can be regarded as unlicensed driving):
(1) The driver of a motor vehicle who drives a motor vehicle without a special driver training school's driving skill training and examination, and then obtains a motor vehicle driving license, is driving without a license;
(2) If the vehicle type of the driver is beyond the scope of the permitted driving vehicle type approved by the driver's license (refer to the table of "permitted driving vehicle type and code" below for comparison), the driver shall drive without license (for example, the driver who only holds the C license drives the B license, or the driver who only holds the B license drives the a license, etc.);
(3) If the driver does not carry with him the driving license of the motor vehicle conforming to the type of vehicle he drives, he shall be regarded as driving without a license;
(4) If a driver's license obtained by forging, altering or other illegal means is used, or has expired or expired, or has been suspended, revoked or revoked, it shall be regarded as driving without a license;
(5) If the age or health condition of the driver does not meet the driving conditions (most of which refer to the situation that the actual age exceeds the maximum age limit of the type of driving, if the age is not enough, it shall be treated as illegal obtaining of a motor vehicle driver's license and classified as (4));
(6) Driving a civil motor vehicle with a driving license of the army or the armed police force (except for those with special license);
(7) Driving in China with an overseas motor vehicle driving license;
2、 Which situations are driving without license:
(1) If the driver of a motor vehicle hands over the motor vehicle to a person who has not obtained the motor vehicle driving license or whose motor vehicle driving license has been revoked or suspended, the motor vehicle driving license shall be withheld and may also be revoked;
(2) If a person drives a motor vehicle without obtaining a motor vehicle driver's license or during the period when the motor vehicle driver's license is revoked or suspended, or if the motor vehicle is handed over to a person who has not obtained a motor vehicle driver's license or whose motor vehicle driver's license is revoked or suspended, he shall be fined not less than 200 yuan but not more than 2000 yuan by the traffic administrative department of the public security organ, and may also be detained for 15 days;
(3) No matter whether the driver violates the law or not in the process of driving, the driver shall not continue to drive the vehicle without the vehicle driving license. The traffic administrative department of the public security organ shall detain the motor vehicle and notify the driver to provide the driving license. a) If the driver's license provided is true, legal and there is no illegal act during driving, a warning or a fine of 20-200 yuan will be given, and the motor vehicle will be returned in time;
b) If the driver's license provided is true and legal, but there is an illegal act at any time, it shall be punished according to the illegal situation and the driver's license not carried with him, and the motor vehicle shall be returned in time;
