According to the provisions of Article 29 of the population and family planning law, the people's Congress and its Standing Committee or people's Government of each province, District, city or larger city shall formulate specific measures for the implementation of the extension of the bonus or other welfare benefits.

How many days of legal marriage leave

The national legal marriage leave is as follows:

I. Beijing: 3 days of marriage leave + 7 days of late marriage leave = 10 days

"Article 20 employees of government organs, social organizations, enterprises and institutions who marry late shall enjoy 7 days of bonus leave in addition to the marriage leave prescribed by the state. In addition to the maternity leave stipulated by the state, female employees with late childbearing shall be given 30 days of bonus leave, which can also be enjoyed by the male side. II. Shanghai: 3 days of marriage leave + 7 days of late marriage leave = 10 days

"Article 33 in addition to enjoying the marriage leave prescribed by the state, citizens who marry late shall have an additional seven days of marriage leave.". In addition to the maternity leave prescribed by the state, the late childbearing women who have given birth in accordance with the provisions of these Regulations shall enjoy an additional 30 days of late childbearing leave, and their spouses shall enjoy three days of late childbearing care leave. III. Guangdong: 3 days of marriage leave (the late marriage leave has been cancelled)

According to the latest regulations on family planning in Guangdong, marriage leave for late marriage has been cancelled. At present, the late marriage employees in Guangdong Province can only enjoy the stipulated three-day leave, not the late marriage leave.

IV. Shaanxi: 3 days of marriage leave + 20 days of late marriage leave = 23 days

"Article 36 the first marriage of a man over the age of 25 and a woman over the age of 23 is a late marriage. If a married woman over the age of 24 gives birth to her first child, it is late childbearing.

If the employee marries late, the marriage leave will be increased by 20 days; if the employee gives birth late, the maternity leave will be increased by 15 days, and the male side will be given 10 days of nursing leave; if the employee receives the "honor certificate of the only child's parents" during the maternity leave, the maternity leave will be increased by 30 days.

"Article 32 in the case of late marriage, the marriage leave shall be increased by 20 days in addition to the marriage leave prescribed by the state; in the case of late childbearing of married women, the maternity leave shall be increased by 30 days in addition to the maternity leave prescribed by the state, and the male nursing leave shall be given 15 days.". Marriage leave, maternity leave and nursing leave shall be regarded as attendance, and wages and bonuses shall be paid accordingly.

The people's governments at the grass-roots level may give appropriate rewards to those who marry or bear children at a later age in rural areas. In January 2016, Sichuan's late marriage leave case was modified, and the provision of bonus for late marriage leave was cancelled.

Vi. Xinjiang: 3 days of marriage leave + 20 days of late marriage leave = 23 days

"Article 25 If state functionaries, social organizations, enterprises and institutions get married late, their marriage leave shall be increased by 20 days in addition to the marriage leave prescribed by the state.". In case of late childbearing of female employees, in addition to the maternity leave prescribed by the state, the maternity leave shall be increased by 30 days and the male nursing leave shall be given 15 days. During the period of marriage leave, maternity leave and nursing leave, the salary and bonus will be paid accordingly.

In case of late marriage or childbearing of farmers and herdsmen, the labor services raised by the collective production and public welfare undertakings of both husband and wife for one year shall be exempted or given corresponding rewards by the local people's government. VII. Yunnan: 3 days of marriage leave + 15 days of late marriage leave = 18 days

"Article 26 for citizens aged 25 and over, those who have registered their first marriage according to law shall be considered as late marriage, and those who have given birth to their first child over the age of 24 shall be considered as late childbearing.

If a staff member of an organ, an enterprise, an institution, a social organization or any other organization marries late, the marriage leave shall be increased by 15 days in addition to the marriage leave prescribed by the state; if the woman gives birth late, the maternity leave shall be increased by 30 days, and the man's nursing leave shall be increased by 7 days; if the only child's parents' certificate of honor is handled during the maternity leave, the woman shall be increased by 15 days.

VIII. Zhejiang: 3 days of marriage leave (the late marriage leave has been cancelled)

Article 36 those who marry late and have children late shall be rewarded and given care. Specific measures shall be formulated by the people's Government of the county (city, district).

In January 2016, Zhejiang late marriage leave case was modified, and the provision of extra reward for late marriage leave was cancelled.

IX. PLA: 3 days of marriage leave + 7 days of late marriage leave = 10 days

"Article 28 in addition to the marriage leave prescribed by the state, the military personnel who marry late shall enjoy an additional 7 days of marriage leave. During the late marriage leave, the salary will be paid and the welfare will remain unchanged.

Both husband and wife are military personnel. If both parties reach the age of late marriage, both parties shall enjoy late marriage leave; if one party reaches the age, the other party shall enjoy it. X. Jilin: 3 days of marriage leave + 12 days of late marriage leave = 15 days

"Article 48 employees who practice late marriage and late childbearing shall be rewarded or given welfare treatment in accordance with the following provisions:

(1) for employees who marry late, their marriage leave shall be increased by 12 days with the marriage certificate;

(2) for female employees who have late childbearing, the maternity leave shall be increased by 30 days on the basis of the reproductive health service certificate, and the male nursing leave shall be given seven days at the same time;

(3) rural villagers shall enjoy preferential treatment as prescribed by the local township (town) people's Government on the strength of marriage certificate or reproductive health service certificate;

(4) persons other than those mentioned in the preceding three paragraphs of this article shall enjoy preferential treatment as prescribed by the local people's government with their marriage certificate or reproductive health service certificate. _

During the period of enjoying marriage leave, maternity leave and nursing leave, the employees who marry late and have children late shall be treated as their normal work, and their wages and bonuses shall be paid as usual, while other welfare benefits shall not be changed. Xi. Jiangsu: 3 days of marriage leave + 10 days of late marriage leave = 13 days

Article 30 for late marriage, the marriage leave shall be extended for ten days. If both husband and wife marry late, they shall enjoy it; if one party marries late, they shall enjoy it. For late childbearing, the maternity leave of the female party shall be extended for 30 days and the nursing leave of the male party for 10 days. The vacations specified in the preceding two paragraphs shall be deemed as attendance and shall not affect wages, bonuses and welfare benefits.
