What is the law against flying the national flag
The law on the national anthem, which came into force on October 1 this year, stipulates that in public places, those who deliberately falsify the lyrics and music of the national anthem, play and sing the National Anthem in a distorted or derogatory way, or insult the National Anthem in other ways, shall be given a warning or detained for not more than 15 days by the public security organ; those who constitute crimes shall be investigated for criminal responsibility in accordance with the law.
China's current criminal law stipulates the crime of insulting the national flag and the national emblem, and the amendment (10) to the criminal law adds a paragraph to Article 299 of the criminal law to stipulate the criminal responsibility for insulting the national anthem. It is clear that whoever, in public, intentionally insults the national flag or the national emblem of the people's Republic of China by burning, damaging, scrawling, defiling or trampling on it shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance or deprivation of political rights.
