How to punish obscenity
The so-called indecency refers to the obscene behavior that is carried out by means other than sexual intercourse for the purpose of stimulating or satisfying sexual desire. The crime of indecency only refers to the use of violence, threats or other means against the will of men, women or children to force indecency or insult men, women or children, and the circumstances constitute a serious crime.
Whoever forcibly desecrates or insults another person by violence, coercion or other means shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention.
Under any of the following circumstances, he shall be sentenced to fixed-term imprisonment of not less than five years but not more than 15 years:
(1) the circumstances of indecency are flagrant.
(2) gathered together or molested others in public.
When the act of indecency does not constitute a crime, it may be punished in accordance with Article 44 of the law on Public Security Punishment: whoever indecency, or intentionally exposes his body in a public place, if the circumstances are flagrant, shall be detained for not less than five days but not more than 10 days; whoever indecency against an intellectual disabled person, a mental patient, a person under the age of 14 weeks, or if there are other serious circumstances, shall be detained for not less than 10 days but not more than 15 days.
