Definition of minimum wage standard

The minimum wage standard does not refer to the basic wage of employees, but refers to the total income of employees including the basic wage. According to the relevant regulations of the state and province, the minimum wage standard shall include the basic wage (or standard wage), bonus and the subsidy (Supplement) of the nature of price compensation issued by the state and provincial and municipal regulations.

The minimum wage standard refers to the minimum labor remuneration that the employer should pay according to law on the premise that the laborer provides normal labor during the legal working hours or the working hours stipulated in the labor contract signed according to law.

Normal labor refers to the labor that the worker is engaged in during the legal working hours or the working hours stipulated in the labor contract according to the labor contract signed in accordance with the law. Labourers shall be deemed to have provided normal labor during the holidays prescribed by the state, such as paid annual leave, family visit leave, marriage and funeral leave, maternity (maternity) leave and birth control operation leave, as well as during the legal working hours when they participate in social activities in accordance with the law. The minimum wage standard is applicable to enterprises, private non enterprise units, individual industrial and commercial households with employees and workers with whom labor relations are formed within the territory of the people's Republic of China.

The minimum wage standard is also applicable to state organs, institutions, social organizations and the workers with whom the labor contract relationship is established. Specifically, the minimum wage standard is only applicable to on-the-job employees, which is not applicable to retirees, early retired employees, employees waiting for work and laid-off employees.
