The applicable groups of the measures for the administration of disability pension include: servicemen who are disabled due to war and work during their service, and disabled servicemen who have been discharged from active service due to illness; The people's police who are the administrative establishment when they are injured in the war or on duty; Reservists, militia, migrant workers and other personnel disabled by participating in war, military exercises, military training and performing military duties; Disabled persons who fight against criminals in order to maintain public security; Persons disabled for the purpose of rescuing and protecting state property and people's lives and property; Other personnel whose disability pensions shall be paid by the Department of Veterans Affairs in accordance with laws and administrative regulations.
Depending on the population, the disabled serviceman certificate of the people's Republic of China, the disabled people's police certificate of the people's Republic of China, the disabled fire rescue personnel certificate of the people's Republic of China, the disabled reserve personnel and disabled militia migrant workers certificate of the people's Republic of China and the disabled personnel certificate of the people's Republic of China on duty will be issued. Among them, the certificate of disabled fire rescue personnel of the people's Republic of China is a new certificate.
The measures are put forward that the disabled personnel shall be pensions from the Department of Veterans Affairs of the county level people's government at the registered residence level, according to the regulations, from the next month after the disabled person has been assessed. If the pension relationship of the disabled is transferred, the pension for the current year shall be paid by the military or the Veterans Affairs Department in the place where they move out, and shall be paid by the Veterans Affairs Department in the place where they move in according to the local standards from the next year. If the pension is cut off due to the applicant, it shall not be reissued.
It also suggested that the disabled person (or their family members) should contact the Department of Veterans Affairs of the county people's government at their registered residence (or the original registered residence) each year, and confirm the treatment of disabled persons through treatment and face recognition. If no contact and confirmation is made in the current year, the Veterans Affairs Department of the people's government at the county level shall make a public announcement or notify itself or its family members to contact and confirm in time; If no contact or confirmation is made within 60 days after the announcement or notification to himself or his family members, the disability pension and related benefits shall be suspended from the next month.
In case of forging disability, falsely claiming pension, defrauding medical expenses, issuing false certificates, forging certificates and seals to defraud pension and related benefits, the Veterans Affairs Department of the people's government at the county level shall give a warning, stop their pension and preferential treatment and recover their illegal income; If a crime is constituted, criminal responsibility shall be investigated according to law.
The measures also apply to the Chinese people's armed police force. Disabled due to work during the deepening of national defense and military reform, civilian personnel transferred from active duty cadres of the army, other civilian personnel disabled due to participating in military training, non war military operations and combat support tasks, fire rescue personnel disabled due to work, and fire rescue personnel with disability rating due to illness, The administration of disability pension after withdrawal from the army or the national comprehensive fire rescue team shall be implemented with reference to the relevant provisions of disabled servicemen discharged from active service. The people's police who are not included in the administrative establishment shall assess the disability level with reference to the measures, and their disability pension shall be paid by their units according to regulations.
