Article 1 These Provisions are formulated in accordance with the road traffic safety law of the people's Republic of China and its implementation regulations, the law of the people's Republic of China on the prevention and control of air pollution and the law of the people's Republic of China on the prevention and control of noise pollution for the purpose of ensuring road traffic safety, encouraging technological progress and accelerating the construction of a resource-saving and environment-friendly society.
Article 2 according to the use, safety technology and emission inspection of motor vehicles, the State shall implement compulsory scrapping of motor vehicles that meet the scrapping standards.
Article 3 the departments of Commerce, public security, environmental protection, development and reform shall, according to their respective responsibilities, be responsible for the supervision and management of the recovery and dismantling of scrapped motor vehicles and the implementation of the compulsory scrapping standards for motor vehicles.
Article 4 a registered motor vehicle shall be scrapped under any of the following circumstances, and its owner shall sell it to the scrapped motor vehicle recycling and dismantling enterprise. The scrapped motor vehicle recycling and dismantling enterprise shall register, dismantle and destroy it according to the regulations, and submit the registration certificate, number plate and driving license of the scrapped motor vehicle to the traffic management department of the public security organ for cancellation:
（1） Reaching the service life specified in Article 5 of these provisions;
（2） After repair and adjustment, it still fails to meet the relevant requirements of the national standards for motor vehicle safety technology for in use vehicles;
（3） After repair and adjustment or adoption of control technology, the emission of pollutants or noise to the atmosphere still does not meet the relevant requirements of the national standards for in use vehicles;
（4） Failing to obtain the motor vehicle inspection mark within three consecutive motor vehicle inspection cycles after the expiration of the inspection validity period.
Article 5 the service life of various types of motor vehicles are as follows:
（1） The service life of small and micro taxis is 8 years, that of medium taxis is 10 years, and that of large taxis is 12 years;
（2） Rental of passenger cars for 15 years;
（3） The service life of small coach passenger car is 10 years, medium coach passenger car is 12 years, and large coach passenger car is 15 years;
（4） The bus has been used for 13 years;
（5） Other small and micro operating passenger cars have been used for 10 years, while large and medium operating passenger cars have been used for 15 years;
（6） The special school bus has been used for 15 years;
（7） Large and medium sized non operating passenger cars (except large cars) have been used for 20 years;
（8） The service life of three wheeled vehicles and low-speed trucks equipped with single cylinder engines is 9 years, that of low-speed trucks equipped with multi cylinder engines and mini trucks is 12 years, that of Dangerous Goods trucks is 10 years, and that of other trucks (including semi trailer and full trailer) is 15 years;
（9） The special operation vehicle with loading function has been used for 15 years, and the special operation vehicle without loading function has been used for 30 years;
（10） The service life of full trailer and semi trailer for dangerous goods transportation is 10 years, that of container semi trailer is 20 years, and that of other semi trailers is 15 years;
（11） The three wheeled motorcycle has been used for 12 years and other motorcycles for 13 years.
The relevant departments of the people's governments of provinces, autonomous regions and municipalities directly under the central government may, in light of the actual local conditions, formulate regulations that are more stringent than the above-mentioned service life for small and micro passenger taxis (except pure electric vehicles) and motorcycles. However, the service life for small and micro passenger taxis shall not be less than 6 years, that for tricycles shall not be less than 10 years, and that for other motorcycles shall not be less than 11 years.
There is no service life limit for small and micro non operating passenger cars, large non operating cars and wheeled special mechanical vehicles.
The starting date of the service life of a motor vehicle shall be calculated according to the date of registration, but if it fails to go through the registration procedures for more than two years from the date of leaving the factory, it shall be calculated according to the date of leaving the factory.
Article 6 a motor vehicle whose nature of use is changed or whose registration is transferred shall have its service life and be scrapped in accordance with the following requirements:
（1） If the operating passenger car and the non operating passenger car are converted to each other, they shall be scrapped according to the provisions of the operating passenger car, but if the small, micro non operating passenger car and large non operating car are converted to the operating passenger car, the accumulated service life shall be calculated according to the formula listed in Annex 1 of these Provisions, and shall not exceed 15 years;
（2） Different types of operating passenger cars are converted to each other and scrapped according to the strict service life;
（3） Small and micro taxis and motorcycles that need to be transferred out of the province, autonomous region or municipality directly under the central government where they are registered shall be scrapped in accordance with the provisions of stricter service life;
（4） If a truck or semi-trailer for the transport of dangerous goods is converted from another truck or semi-trailer, it shall be scrapped in accordance with the provisions of the truck or semi-trailer for the transport of dangerous goods.
A motor vehicle with a service life of less than one year (including one year) required by these Provisions shall not change the nature of use, transfer ownership or transfer out of the municipal administrative region of the place of registration.
Article 7 the State shall guide the scrapping of motor vehicles that have reached a certain mileage.
The owner of a motor vehicle with the following mileage may sell the motor vehicle to the scrapped motor vehicle recycling and dismantling enterprise. The scrapped motor vehicle recycling and dismantling enterprise shall register, dismantle and destroy the motor vehicle according to the regulations, and submit the scrapped motor vehicle registration certificate, number plate and driving certificate to the traffic Management Department of the public security organ for cancellation
