What is maternity leave

Maternity leave refers to the leave treatment of working women before and after childbirth, generally from half a month before childbirth to two and a half months after childbirth. Late marriage and late childbirth can be extended to four months before and after childbirth. Female workers enjoy no less than 90 days of maternity leave. (Article 62 of the labor law of the people's Republic of China) this article does not limit the number of inspection, that is, as long as the inspection is normal and necessary, it should be included in the labor time. It can not be counted as sick leave, personal leave, maternity leave, absenteeism, etc.

National regulations on maternity leave in 2019

According to the new Labor Law:

1. During the first six months of pregnancy, you can enjoy one day holiday for pregnancy confirmation, application for fertility indicators, and production training.

2. In the sixth and seventh month of pregnancy, one day of vacation is available each month.

3. Pregnant 8 months, can enjoy 2 days holiday. Pregnant more than 9 months, can enjoy 4 days of leave, but 2 of them have been included in the maternity leave.

Is maternity leave one day or half a day

According to the state regulations, pregnant women are entitled to maternity leave after pregnancy. Within the specified scope, pregnant women go to the hospital for maternity check-up, which is regarded as normal attendance. The specific provisions are as follows:

For the first six months of pregnancy, one day of leave can be enjoyed every month for pregnancy confirmation and health training; for the sixth seven months of pregnancy, one day of leave can be enjoyed every month; for the eighth month of pregnancy, two days of leave can be enjoyed every month; for more than nine months of pregnancy, four days of leave can be enjoyed every month, but two of them have been included in the expected maternity leave.

When we need to pay attention, many pregnant women do not know whether the number of maternity leave is limited. According to the relevant regulations, there are no regulations on the number of times and days for pregnant women to apply for maternity leave, and employers are not allowed to count maternity leave as sick leave, personal leave, maternity leave and so on.
