How to have a holiday on May Day? May Day holiday arrangement

It's going to be labor day this year. The holiday arrangement of labor day in 2019 is as follows: go to work on April 28 and may 5, and have a holiday from May 1 to May 4.

After the founding of new China, the Government Affairs Council of the Central People's government designated May 1 as the legal labor day in December 1949, a national holiday. On this day of every year, the whole country celebrates. People put on their festive costumes and gather in parks, theaters and squares to participate in various celebration gatherings or recreational activities, and commend the workers who have made outstanding contributions.

May day overtime wage calculation method

The state stipulates that may 1 has one day off: overtime on this day will be paid according to three times of the salary standard.

On May 1, overtime pay = monthly wage income & divide; 21.75 days (monthly paid days) & times; 300%.

The wage income here refers to the basic wage, excluding bonus, allowance and various subsidies.

When calculating overtime wage, the daily wage is converted to 21.75 days per month, and the hourly wage is divided by 8 hours on the basis of daily wage. When determining the calculation base of overtime pay, if there is a clear agreement on the wage in the labor contract, it shall be determined according to the wage standard corresponding to the position of the worker. If there is no clear stipulation on wages in the labor contract, it shall be implemented according to the collective contract. If there is no agreement between the employer and the employee, 70% of the monthly salary of the employee's normal attendance shall be determined.

On May Day, three types of people are not allowed to work overtime

Employers can not force employees to work overtime, and have no right to deduct wages. If the employer fails to negotiate with the employee and the trade union in advance, or the overtime arranged by the employer violates the relevant provisions of labor laws and regulations, the employee has the right to refuse to work overtime. At the same time, employees are not allowed to work overtime under the following circumstances:

1. Pregnant women should not extend their working hours;

2. If female employees are pregnant for more than 7 months, the employer cannot arrange them to work overtime;

3. During the lactation period, the employer can not arrange overtime for female employees.

Is overtime pay taxable

Article 8 of the regulations on the implementation of the individual income tax law of the people's Republic of China stipulates that wage and salary income refers to the salary, salary, bonus, year-end pay increase, labor bonus, allowance, subsidy and other income related to the post or employment of an individual. It can be seen that overtime wages on holidays belong to the scope of income from wages and salaries. The tax payable on wages and salaries is calculated and levied on a monthly basis. If the accumulated wages of workers, including monthly overtime income, reach the level of tax deduction, they should pay individual income tax.
