Article 251 of the Civil Procedure Law of the people's Republic of China, in the course of execution, if it is necessary to go through the relevant procedures for the transfer of property ownership certificate, the people's court may issue a notice of assistance in execution to the relevant unit, which must go through the procedures.
Judicial interpretation of Civil Procedure Law
Article 491 with the consent of the person applying for execution and the person subjected to execution, and without prejudice to the lawful rights and interests of other creditors and public interests, the people's court may, without auction or sale, directly value the property of the person subjected to execution and pay it to the person applying for execution to pay off the debt. The person subjected to execution shall continue to pay off the remaining debts.
Article 492 if the property of the person subjected to execution cannot be auctioned or sold off, the people's court may, with the consent of the person applying for execution and without prejudice to the legitimate rights and interests of other creditors and the public interest of the society, deliver the property to the person applying for execution for payment of his debts or for its management; if the person applying for execution refuses to accept or manage the property, it shall be returned to the person subjected to execution.
Article 493 where an auction is concluded or an order is made in accordance with the procedure, the ownership of the subject matter is transferred from the time when the order of auction is concluded or the order of debt is delivered to the buyer or the creditor who accepts the debt.
Article 502 if the people's court needs to go through the procedures of transferring the property ownership certificate such as the house property certificate, land certificate, forest ownership certificate, patent certificate, trademark certificate, vehicle and vessel license in the course of execution, it may do so in accordance with the provisions of article 251 of the civil procedure law.
