1、 How to deal with a new employee who doesn't buy social security

Take with you the labor contract signed with the employee in triplicate, and the employee's employment and unemployment registration certificate;

1. If the official seal can be taken, bring the official seal and the completed "employment registration personnel record form", in this case, the "employment registration personnel roster" is printed by the social security institution, and only need to be stamped with the official seal;

2. If you can't bring the official seal, fill in the complete "employment registration personnel record form" and "employment registration personnel roster" and affix the official seal;

3. If the employee has not yet renewed the employment and unemployment registration certificate, he / she should bring a photo of the employee and apply for the certificate at the same time when handling the social security; the above procedures should be stamped on the employment and unemployment registration certificate.

Social security for new employees:

1. Except for special reasons, each person has only one social security account;

2. When entering a new company, if an employee has a social security account, he / she should apply to the social security bureau to stop his / her account (with the original ID card);

3. If the new employee has no social security account, the original ID card of the employee shall be submitted (the original ID card shall be provided to the Social Security Bureau for scanning and making the medical insurance card);

2、 Relevant regulations

When employing workers, the employing unit shall truthfully inform the workers of the work content, working conditions, working place, occupational hazards, production safety status, labor remuneration and other information required by the workers; the employing unit has the right to know the basic information of the workers directly related to the labor contract, and the workers shall truthfully explain it.

When employing a laborer, the employer shall not detain the laborer's resident identity card or other certificates, require the laborer to provide a guarantee or collect money from the laborer in other names, such as material objects.

If an employing unit, in violation of the provisions of this law, seizes a laborer's resident identity card or other certificates, the labor administrative department shall order it to return the laborer himself within a time limit and impose a penalty in accordance with relevant laws. If workers are infringed in the process of work, they can rely on legal means to safeguard their legitimate rights and interests.

Where an employing unit, in violation of the provisions of this law, collects property from a laborer in the name of guaranty or other means, the labor administrative department shall order it to return the property to the laborer within a time limit, and impose a fine of not less than 500 yuan but not more than 2000 yuan per person; if damage is caused to the laborer, it shall be liable for compensation.

If an employing unit recruits workers whose labor contracts with other employing units have not been dissolved or terminated, and causes losses to other employing units, it shall bear joint and several liability for compensation.
