Paragraph 2 of Article 72 of the road traffic law: the traffic police shall inspect and inspect the scene of a traffic accident and collect evidence; they may detain the vehicles involved in the accident due to the need of collecting evidence, but they shall keep them properly for verification.

2、 When can the traffic police pick up the car after the case is filed

Case filing refers to a kind of litigation activity that the public security, judicial organs and other administrative law enforcement organs decide to investigate or try as a criminal case when they consider that there are criminal facts and need to be investigated for criminal responsibility after reviewing the materials such as reporting, accusation, report, surrender and private prosecution according to their respective jurisdiction.

The traffic police can pick up the car for up to 30 days after the case is filed.

According to Article 44 of the provisions on traffic accident handling procedures, the traffic management department of the public security organ shall, within five days from the date when the conclusion of inspection and appraisal is determined, notify the party concerned to collect the detained accident vehicle, vehicle driving license and seized articles.

If the driver's runaway ownerless vehicle or the vehicle which is still not claimed after 30 days' notice fails to accept the treatment after three months' public announcement, the detained vehicle shall be dealt with according to law.
