In addition to national regulations, there are also regulations around the country on marriage leave. How many days is the marriage leave? Is it true that the late marriage and late childbearing leave has been cancelled? What are the national regulations on marriage leave?

Editor's note:

According to the newly revised population and family planning law, the reward for late marriage and late childbearing leave has been cancelled, but Article 6 of the marriage law of China still stipulates that late marriage and late childbearing should be encouraged. Therefore, whether the late marriage and late childbearing leave can be completely cancelled remains to be specified by the local people's Congress legislation.

Before the local amendment came into force, the provisions on late marriage and late childbearing could still be applied by reference.

Taking Sichuan as an example, Tian Wanguo, vice chairman of the Legislative Affairs Committee of the Sichuan Provincial People's Congress, said that at present, the provincial health and Family Planning Commission and the Provincial Legal Affairs Office and other departments are drafting the amendment (Draft). After the drafting is completed, it can be submitted to the Standing Committee of the provincial people's Congress for deliberation and implementation only after it is approved. Before the implementation of the amendment, the late marriage and late childbearing leave in Sichuan was still implemented in accordance with the current regulations. Zhong Jianlin, vice chairman of the education, science, culture and Health Committee of the provincial people's Congress, said that the earliest time to submit for deliberation would be next March's meeting of the Standing Committee of the provincial people's Congress.

[1980] l.z.c.z. No. 29 stipulates that: 1-3 days of marriage and funeral leave shall be given if the two parties are not in the same place. At that time, this document was only for state-owned enterprises. Usually we count it as three days at most.

Article 25 of the population and family planning law of the people's Republic of China: if a citizen marries late and gives birth late, he or she may be granted extended marriage leave, reward for maternity leave or other welfare benefits.

The draft of the population and family planning amendment amended article 25 to read: "if a citizen marries late and gives birth late, he / she may be granted extended marriage leave, maternity leave reward or other welfare treatment" as "if he / she has given birth to children in accordance with the provisions of Article 18 of this law, he / she may be granted extended maternity leave reward or other welfare treatment".

According to the provisions of Article 29 of the population and family planning law, the people's Congress and its Standing Committee or people's Government of each province, District, city or larger city shall formulate specific measures for the implementation of the extension of the bonus or other welfare benefits.
