1、 How to calculate the overtime wage on National Day 2018

2、 What are the legal provisions for overtime pay

2. In case of working on a rest day, it is necessary to arrange a supplementary leave of the same time. If it is not possible to arrange a supplementary leave, it shall pay the overtime wage at not less than 200% of the daily or hourly wage base;

3. In case of working on a statutory holiday, the overtime wage shall be paid at least 300% of the daily or hourly wage base.

The base of calculating overtime wage shall be determined according to the wage standard of the laborer stipulated in the labor contract. If there is no agreement in the labor contract, it shall be determined according to the overtime wage base agreed in the collective contract; if there is no agreement in the labor contract or the collective contract, it shall be determined according to the wage due to the normal work of the worker himself.

The employer may not pay overtime wages to the laborers who have been approved to implement the irregular working system.
