According to relevant laws and regulations, September 24, October 1 to October 3 are national legal holidays. If the employer arranges workers to work overtime from September 22 to September 23, October 4 to October 7, the rest day is optional If the overtime pay is not paid, the overtime pay shall not be less than 200% of the employee's daily or hourly wage. It should be noted that no matter 300% or 200% of overtime wage, the employer needs to pay additional wage after paying the monthly wage of the employee.

In the Mid Autumn Festival holiday, if you earn more than one third of your monthly salary for three days of overtime, how do you calculate the overtime pay? According to the original notice of the Ministry of labor on the annual average working hours and wage conversion of employees, when the employer converts the monthly wage of employees into the daily wage, the monthly wage days should be converted as 21.75 days. For full-time employees, if the monthly wage base is 8467 yuan, the daily overtime from September 24, October 1 to October 3 is 1167.86 yuan, and the daily overtime from September 22 to September 23, October 4 to October 7 is 778.57 yuan. If you work overtime for three days during the Mid Autumn Festival holiday and don't take compensatory leave, you can get 2725.01 yuan of overtime pay, close to one third of your monthly salary. If you work overtime for 7 days during the National Day holiday and don't make up for it, you can get an overtime pay of 6617.89 yuan, close to 80% of your monthly salary.
