Recently, the Ministry of housing and urban rural development, together with the Ministry of finance, the people's Bank of China and the Ministry of Public Security jointly issued the notice on the implementation of the work of illegal extraction of housing fund, which requires priority to support the extraction of housing fund to pay rent, and the amount of extraction should be reasonably determined and timely adjusted according to the local rent level.

According to the notice, the priority is to support the withdrawal of housing fund to purchase the first ordinary housing and the second improved housing in the place of deposit or household registration, so as to prevent the withdrawal of housing fund for speculation.

Four departments: prevent the withdrawal of provident fund for speculation

According to the notice, if the same person changes the marriage relationship for many times to buy a house, many people buy and sell the same house frequently, or buy a house in a different place, especially in a non deposit place where the household registration is not made, or a non spouse or non lineal relatives jointly buy a house and apply for housing provident fund, the authenticity of the housing consumption behavior and supporting materials shall be strictly examined.

In case of cancellation or termination of the labor relationship between the deposited employee and the unit, the individual account shall be sealed first. During the period of account sealing, if a housing accumulation fund account is opened in a different place and deposited stably for more than half a year, the transfer and continuation procedures in a different place shall be handled. If it is not deposited in another place, it can be withdrawn after half a year of sealing. All localities shall, in accordance with the above requirements, complete the normative adjustment of local policies by the end of June 2018.

For the employees who have illegally withdrawn the housing accumulation fund, the housing accumulation fund management center shall record their dishonest records and transfer them together with their personal accounts; for those who have withdrawn, they shall be ordered to return them in full within a certain period of time, and the withdrawal and loan of the housing accumulation fund shall be restricted within a certain period of time.

Three departments: determine the deposit proportion within the upper limit of the prescribed provident fund

On April 11, the Ministry of housing and urban rural development and other three departments issued a notice to extend the policy of reducing the proportion of enterprise housing accumulation fund to April 30, 2020. In addition, the payer can independently determine the proportion between the lower limit of 5% and the upper limit of 12%. It is reported that this can reduce the burden of enterprises by about 30 billion yuan.

According to the notice issued by the three departments, the lower limit of the proportion of housing accumulation fund is 5%, and the maximum is no more than 12%. And extend the period of the policy of reducing the proportion of enterprise housing accumulation fund.

Regulate the upper limit of the base of housing accumulation fund payment, and the monthly wage base of housing accumulation fund payment shall not be higher than 3 times of the average monthly wage of the employees in the previous year published by the Statistics Department of the city divided into districts where the employees work. If it exceeds 3 times, it shall be regulated and adjusted. The lower limit of the proportion of housing accumulation fund is 5%, and the upper limit shall be determined by each region according to the procedures stipulated in the regulations on the administration of housing accumulation fund, and the maximum limit shall not exceed 12%. The deposit unit can determine the proportion of housing accumulation fund within 5% to the upper limit of local regulations.

Enterprises with difficulties in production and operation can apply for reducing the proportion of housing accumulation fund or delaying the payment after being discussed and approved by the workers' Congress or the labor union. The Management Committee of housing accumulation fund shall authorize the management center of housing accumulation fund to examine and approve, and the time limit for examination and approval shall not exceed 10 working days.
