On the same day, the Yulin intermediate people's Court issued the twelfth batch of dishonest Executees, 156 in total, with a total subject matter of 239.79 million yuan. Meanwhile, it issued a high consumption restriction order to the dishonest Executees, and declared the exit and entry certificates held by them invalid.

The reporter found that Zhu, a 30-year-old woman, owed RMB 171.71 million in the first phase of the list of 80 people who were dishonest and executed issued by Yulin intermediate people's court. As soon as the list was published, there was widespread debate. Many people thought that it was "not easy" for the woman to owe hundreds of millions of yuan.

The reporter learned that from 2011 to 2013, Bai (male) successively borrowed a total of 171.1 million yuan from Zhu. On November 18, 2013, after negotiation between the two parties, Zhu Mou rounded up the capital interest of RMB 171.1 million and the period, and issued a loan of RMB 180 million to Bai Mou to clarify the creditor's rights.

According to Bai, Zhu has not repaid the loan to him, and his behavior has seriously breached the contract and infringed his legitimate rights and interests. He sued Zhu to the higher people's Court of Shaanxi Province and claimed that Zhu would repay 180 million yuan of his loan.

The woman said the note was coerced by the man when they lived together

During the trial, Zhu argued that she had lived with Bai for four years from 2010 to June 2014, during which time, she never borrowed money from Bai. Although Bai has made money to her, it is all for the expenses of living together and the compensation after beating her every time, rather than the loan she borrowed from Bai.

Zhu believes that the loan slip held by Bai is not a representation of the real loan of both parties, and that the fact of loan has not actually occurred to both parties. In February 2014, she had a quarrel with Bai Mou because of trifles. In order to prevent her from living together with her, Bai Mou cut her hair with scissors and forced her to write the loan note of 180 million yuan held by Bai Mou. When writing the loan note, she was also required to write the time on November 18, 2013. The loan note was completely a means for Bai Mou to control her long-term cohabitation relationship with her.

The court rejected the woman's claim and adjudicated the repayment

After accepting the case, the Shaanxi Higher People's court held that the RMB 171.1 million loan relationship between baimou and ZhuMou was the true intention of both parties, which did not violate the mandatory provisions of laws and regulations and should be effective. Among Bai's claims for 180 million yuan of private loans, 171.1 million yuan was fully supported. The claim for the rest of the money is not supported on insufficient basis. In the first trial of Shaanxi Provincial Higher People's court, Zhu returned 171 million yuan of loan to Bai.

After the first trial, Zhu refused and appealed to the Supreme People's court. The Supreme People's court rejected the appeal and upheld the original ruling.

It is understood that on October 17, 2017, the Yulin intermediate people's court filed the case for execution, and on November 6, 2017, Zhu was listed as the dishonest person to be enforced. Bai Dongping, President of the executive chamber of Yulin intermediate people's court, said Zhu took the initiative to negotiate with the parties on November 27 and decided to fulfill all repayment obligations.
