2017 Dragon Boat Festival overtime wage calculation standard
Where an employer arranges labourers to work outside the standard working hours in accordance with the law, it shall pay overtime wages in accordance with the following standards:;
1. If the working hours are extended beyond the daily standard working hours, the overtime wage shall be paid at not less than 150% of the hourly wage base;
2. In case of working on a rest day, it is necessary to arrange a supplementary leave of the same time. If it is not possible to arrange a supplementary leave, it shall pay the overtime wage at not less than 200% of the daily or hourly wage base;
3. In case of working on statutory holidays, overtime pay shall be paid at least 300% of the daily or hourly wage base.
The base of calculating overtime wage shall be determined according to the wage standard of the laborer stipulated in the labor contract. If there is no agreement in the labor contract, it shall be determined according to the overtime wage base agreed in the collective contract; if there is no agreement in the labor contract or the collective contract, it shall be determined according to the wage due to the normal work of the worker himself.
The employer may not pay overtime wages to the laborers who have been approved to implement the irregular working system.
Overtime = normal working day overtime + rest day overtime + legal rest day
Overtime pay = monthly wage base / 21.75 * 150% * overtime on normal working days + monthly wage base / 21.75 * 200% * overtime on rest days + monthly wage base / 21.75 * 300% * overtime on Legal rest days.
2017 Dragon Boat Festival expressway is not free
According to the 2017 high-speed free schedule released by the State Council, the Spring Festival, Qingming Festival, labor day and National Day holidays are free for 20 days, while the new year's day, Dragon Boat Festival, Mid Autumn Festival and other festivals continue to charge tolls.
