Overtime payment calculation method

Article 44 of the labor law of the people's Republic of China: in case of any of the following circumstances, the employing unit shall pay the wage remuneration higher than the normal working hours wage of the laborer according to the following standards:

(1) if an employee is arranged to extend his working hours, he shall be paid not less than 150% of his salary; (150% * daily salary)

(2) to pay not less than 200% of the wages of a worker who arranges his work on a rest day but is unable to make up for the rest; (200% & times; daily wages);

(3) if a laborer is arranged to work on a statutory holiday, he shall be paid not less than 300% of his wages. (300% * daily salary)

Article 51 The employing unit shall pay wages according to law to labourers during their statutory holidays, marriage and funeral leave, and during their participation in social activities according to law. (100% paid).

Overtime pay and compensatory leave will not increase because of holiday overlap.
