Recently, Dali Prefecture, Yunnan Province held a meeting to announce and implement the regulations on the protection and administration of Erhai Lake of Dali Bai Autonomous Prefecture, Yunnan Province (Revised) and the regulations on the protection and administration of Cangshan Mountain of Dali Bai Autonomous Prefecture, Yunnan Province (Revised). The two regulations will go into effect on December 1. It is understood that the regulations on the protection and administration of Erhai Lake in Dali Bai Autonomous Prefecture of Yunnan Province came into force on March 1, 1989 and were revised three times in 1998, 2004 and 2014; The regulations on the protection and administration of Cangshan Mountain in Dali Bai Autonomous Prefecture of Yunnan Province came into force on October 1, 2002 and was revised once in 2009. Through this revision, the applicability and operability of the two regulations have been further enhanced.
The revised regulations on the protection and management of Erhai Lake has eight chapters and 60 articles, which have revised the legislative purpose, protection principles, spatial control and industrial structure adjustment of Erhai Lake Basin. The most prominent feature is that the protection and management scope of Erhai Lake is divided into class I, II and III Protection Areas, and the protection and management of protection areas at all levels are stipulated; Further clarify the protection and management responsibilities of Autonomous Prefecture, Dali City, Eryuan County and towns in the basin, and add provisions on the functions and responsibilities of Erhai protection and management organization in Eryuan County. The planning and control, infrastructure construction, transformation and development, ecological protection, agricultural non-point source pollution prevention and control, garbage and sewage treatment, water environment monitoring and scientific research involved in the protection and management of the whole Erhai Basin are sorted and standardized; The management of fishing, wharf, cruise ship and related activities in Erhai Lake area has been revised, and the legal liability has been further standardized. The revised regulations clarify the legal liability: those who use water aircraft without authorization shall be ordered to stop the illegal act and be fined not less than 10000 yuan but not more than 50000 yuan. If there are illegal gains, the illegal gains shall be confiscated; Those who set up sheds, set up stalls or set up businesses in Erhai Lake area and lakeside zone without authorization shall be ordered to stop the illegal act, confiscate the illegal income and may also be fined not less than 100 yuan but not more than 1000 yuan. Whoever cleans vehicles, pets, livestock and poultry, agricultural products and production and living appliances in Erhai Lake area and lakeside zone, if the circumstances are minor, shall be fined not less than 200 yuan but not more than 1000 yuan; If the circumstances are serious, a fine of not less than 1000 yuan but not more than 5000 yuan shall be imposed.
The revised regulations on the protection and administration of Cangshan Mountain has five chapters and 35 articles. According to the relevant superior law and the relevant requirements of the state on establishing a natural reserve system with national parks as the main body, the legislative purpose and protection and management principles have been revised; A chapter on protection and management responsibilities is set up to clarify the responsibilities of relevant counties, cities and departments at all levels; The scope and object of protection management have been defined more scientifically and accurately, the protection management measures have been further refined, the relevant prohibited acts have been revised, and the legal liability has been further standardized. The revised regulations clarify the legal liability: those who litter or depict or smear on the scenery or facilities shall be ordered to restore to the original state or take other remedial measures by the Cangshan protection and management organization, and a fine of 50 yuan shall be imposed; Whoever portrays, smears or intentionally damages cultural relics, places of interest and historic sites protected by the state in other ways shall be punished in accordance with the relevant provisions of the law of the people's Republic of China on administrative penalties for public security; Whoever picks flowers, fruits, stems and leaves without authorization shall be ordered by the Cangshan protection and administration institution to stop the illegal act and may also be fined not less than 100 yuan but not more than 500 yuan; If losses are caused, it shall be liable for compensation according to law.
Erhai Lake is the foundation of Dali's sustainable development, and Cangshan Mountain is an important part of the World Geopark. Through this revision, the applicability and operability of the two regulations will be further enhanced, which will provide a more perfect and powerful legal guarantee for the protection and management of Erhai and Cangshan.
