Resale of Cai Yuanpei's former residence

Resale of Cai Yuanpei's former residence

By the West Lake, near the botanical garden, there is a 'former residence of Cai Yuanpei' at No. 1 Yuquan Road. Citizens waiting for bus No. 28 at Yuquan station, if they look up the mountain, may aim at these Western-style historical buildings of the Republic of China in the green trees.

No. 1, Yuquan Road, has attracted the public's attention because of a listing news from a real estate agent these two days. According to the listing news, it has a 'construction area of 276.08 square meters, a basement of 300 square meters, a garden of 4000 square meters, a single house, a single family, good privacy and complete reconstruction procedures', and the listing price is 150 million yuan.

Celebrity effect, out of print location and hundreds of millions of total price. For a time, everyone's curiosity was aroused.

Is the legendary "Cai Yuanpei's former residence" genuine? Why should we emphasize 'complete renovation procedures'? Can the former residences of celebrities be rebuilt by themselves? What is the value of this former residence and what kind of valuation will professionals give?

Reporter 'explore' former residence

The house was withered and the weeds were higher than the head

On the morning of November 10, according to the navigation display of "No. 1 Yuquan Road", the reporter came to a parking lot near the north gate of the botanical garden and looked back and forth for more than ten minutes, but he didn't find his "former residence". The signboards in the botanical garden do not have any signs or hints of Cai Yuanpei's former residence.

Asked the parking lot staff, and asked five people in a row. Whether it was' No. 1 Yuquan Road 'or' Cai Yuanpei's former residence ', they shook their heads and said they didn't know; I went to ask the aunt in the canteen at the entrance of the botanical garden. An aunt said, "I haven't heard of my former residence. You can either go to the botanical garden bus station and have a look. It seems that there are two villas and foreign houses."

Sure enough, at the bus Yuquan station at the gate of the botanical garden, near the intersection of Yugu road and Yuquan Road, you can vaguely see a small building halfway up the mountain.

Walk up the flagstone Road, winding all the way. Insects can't be heard in the roadside trees. There is a small building that looks very dilapidated in the green trees on the hillside. If you are not in the golden area of the West Lake scenic spot, you will think you have seen the old house in the mountains and forests.

Before reaching the small building, the reporter met a couple who went down the mountain along the slate Road, 'it's a big square here, without a house'. The dilapidated house was completely ignored.

The reporter continued to walk to the small building, more and more 'overgrown with weeds'. When you come to a fork in the road, a stone tablet stands on the left branch, with the words "Hangzhou historical building, the old house of CAI William, the daughter of Cai Yuanpei, and his son-in-law Lin Wenzheng, built in the 1930s, including three Western-style buildings".

Come closer, it's really shabby! The villa is divided into three rows of buildings. The front row is a sloping bungalow with brick and wood structure. On the rusty gate, there is also a couplet of "safe access". An old wire hangs from the door, and a thick spider web is formed at the foot of the door and the corner of the wall.

The door is locked. Through the thick gap between your fingers, you can see that there is a house full of dust, only a bed of bedding and a few daily necessities. Everything in the house seems so depressed, except an octagonal retro chandelier with the style of the Republic of China.

Behind are two rows of buildings. The middle row is only broken walls. It doesn't look like a house at all. The skeleton of the back row of houses is still there, but it has withered. The white walls are mottled, the tiles are scattered, the red paint door has broken two holes, and the windows have become empty shelves. One wall has also cracked a large piece, exposing the bamboo strips in the partition of the old bottom wall.

There is a yard in front of the villa. It can be seen that it was originally a garden, but now it has become a wasteland. I don't know who 'opened up the wasteland' in one corner of the yard and planted several rows of small vegetable seedlings.

The weeds are overgrown here, higher than the head. Although the reporter had the courage to stay for half an hour, he really couldn't 'Trek' the corners of the whole villa. Meanwhile, three groups of people passed by, all in company. They basically ignored the small building and passed without stopping.

This is a gift from my father to my daughter

Cai Yuanpei once wrote "Malingshan house"

This villa has a deep relationship with Cai Yuanpei. However, its disputes have also caused a sensation in Hangzhou.

In 1928, with the help of Cai Yuanpei, Lin Wenzheng married Cai William, Cai Yuanpei's eldest daughter.

The second year after their marriage, Cai Yuanpei gave his daughter a sum of money and the savings of his son-in-law Lin Wenzheng. The villa was built in the 1930s.

At that time, this style of house was called 'foreign house'. This foreign-style house has black tiles and pink walls, mud walls and wooden floors, scattered from top to bottom. The front is a bungalow, the back is a building, there are large and small gardens, a number of ancillary houses and a well. It is said that this house is almost the work of CAI William, a famous female painter of the Republic of China. She designed the wall, window flowers and iron door herself.

After the completion, there is no first-hand data to demonstrate whether Cai Yuanpei has lived here.

"But Cai Yuanpei asked himself & lsquo; MALINGSHAN House & rsquo; A plaque, it is true. " Zhong Xiangping, vice president of the Hangzhou historical society, told reporters that there were many villas built by artists nearby. "At that time, the National Academy of Art (now & lsquo; Chinese Academy of Art & rsquo;) was near the autumn moon of Pinghu, and Lin Fengmian's old houses were also in this area."

Ten years ago, he changed his master with 10 million yuan

A bitter dispute lasted for years

In 1939, William Tsai died of puerperal fever, leaving six children.

In 1989, Lin Wenzheng also died. Before his death, he had written evidence that the property was jointly inherited by his children and grandchildren. Before the property was divided and attributed to each child, it was all entrusted to Lin Zhengming, one of his children.

The tenant Li has rented and used the house on the south side of the property since 1991.

In October 1992, Lin Zhenming's sister, Lin Tanwei, signed a real estate transfer contract with Li, which agreed that Li would pay Lin Tanwei 50000 yuan. According to the floor area of Li's bungalow, 53.6 square meters of real estate was allocated to Li &hellip& hellip; The contract was notarized by Qujing Notary Office of Yunnan Province.

After the agreement was signed, Li paid the house purchase price of 50000 yuan to Lin Tanwei. Since then, Li has been living in the old house.

From October 1998 to August 2005, the heirs of the houses here successively gave their inherited property rights to Lin Zhengming. Among them, in August 2005, Lin Tanwei and his husband also donated the property right of the house to Lin Zhengming. In September 2005, Lin Zhengming and his spouse obtained the ownership certificate of house 1, Yuquan Road.

Disputes over housing began.

Since January 2006, Lin Zhengming and his spouse requested Li to move out through litigation and application for execution, but Li refused to cooperate.

In July 2010, Lin Zhengming and his spouse transferred the House No. 1, Yuquan Road to Mr. and Mrs. Zhang at the price of 10 million yuan, and went through the formalities of property right transfer registration.

From 2006 to 2014, Li fought three lawsuits with Lin Zhengming and his wife, Lin Tanwei (Lin Zhengming's sister) and the then Hangzhou housing management department. Finally, the court ruled that the house sales contract between Zhang and Lin Zhengming was valid.

In November 2015, Zhang and his wife sued to the West Lake court, demanding that Li vacate the house immediately and compensate the economic loss of 2 million yuan.

After hearing, the West Lake court ruled that Li vacated house 1, Yuquan Road and compensated Mr. and Mrs. Zhang for the loss of 300000 yuan from July 29, 2010 to November 10, 2015.

In December 2017, Zhang and his wife applied to the West Lake court for enforcement. The West Lake court enforced the payment of 300000 yuan to Zhang and his wife in January 2018 and forcibly vacated them in July 2018.

Since then, the old house has finally calmed down.

It is worth mentioning that the old house was identified as a class C dangerous house in 2008 (the bearing capacity of some load-bearing structures can not meet the requirements of normal use, and some dangerous situations occur locally, forming a local dangerous house).

It is a historical building rather than a cultural protection unit

Sale and repair are allowed after approval

The original grievances and disputes in this suite have now become a thing of the past.

According to Zhong Xiangping's research, No. 1 Yuquan Road is not Cai Yuanpei's former residence, but the former residence of his daughter and son-in-law. The house is not a 'cultural relics protection unit', but a 'historical building'.

"Cultural protection units and historical buildings belong to two different levels." Zhong Xiangping said that the level of protected buildings is divided into national cultural protection, Zhejiang cultural protection, Hangzhou cultural protection and Hangzhou historical buildings from top to bottom.

Historical buildings are private products. They can be bought and sold as long as there is a formal property right certificate, and their owners should do their duty to protect them. For example, when it is necessary to repair or change the use purpose, it shall be reported to the Housing Administration Bureau, the history insurance office and other departments for review and approval before the construction can be started.

No. 1, Yuquan Road, as a dilapidated house, is uninhabitable, so the original demolition, original construction or future transformation and decoration shall be within the scope specified in the property right certificate, the area shall not be expanded, the original floor height shall be maintained, and the style shall be Chinese or new Chinese as far as possible.

Zhong Xiangping believes that the house is "of high cultural and historical value" and is full of stories. The story about the former owners Cai William and his wife, Cai Yuanpei, and Cai Yuanpei's grandchildren can't be finished day and night, and can be written into a book. " Like Xu Qingfu's former residence on Changsheng Road on the West Lake, which was auctioned a few months ago, it can be said that its subsequent value is far from being explored. "

"Cai Yuanpei's former residence" has many places

"In fact, there are several former residences of Cai Yuanpei on the mainland." Zhong Xiangping said.

How to define the former residence of celebrities? It can be determined that celebrities have lived for a period of time.

Zhong Xiangping introduced that Cai Yuanpei's former residence, No. 13, bifeinong, Xiaoshan Street, Shaoxing City, is the only celebrity Memorial Hall in China that specially introduces Cai Yuanpei's life and deeds. It is a national key cultural relics protection unit.

No. 75, dongtangzi Hutong, Dongcheng District, Beijing, was rented by Cai Yuanpei when he was president of Peking University from 1917 to 1923. It was also named 'former residence of Cai Yuanpei'.

Cai Yuanpei rented the three-story residence at No. 16, Lane 303, Huashan Road, Shanghai, and is now recognized as "Cai Yuanpei's former residence". It is a municipal cultural relics protection unit in Shanghai.

In addition, Cai Yuanpei also lived in chunrun Lu on Beishan street in Hangzhou. Chunrunlu is currently recognized as a historical building.

Zhong Xiangping said that Cai Yuanpei's life experience is rich, involving many regions, and he has lived in more than these places.

No. 1, Yuquan Road, has experienced nearly a hundred years of wind and rain and entanglement of gratitude and resentment. We also look forward to finding the next destined person, being properly protected and blooming again.
