If you want to insist on breastfeeding, it's not enough to have your mother's will. You need the care of your family, the guarantee of your employer and the comprehensive support of social software and hardware. On October 29, the regulations of Guangzhou Municipality on the promotion of breastfeeding was adopted at the 28th meeting of the Standing Committee of the 15th Guangzhou Municipal People's Congress and will be officially implemented after being reviewed and approved by the Standing Committee of the provincial people's Congress. It is the first local regulation to promote breastfeeding in China.

The bill was jointly put forward by 74 deputies to the Municipal People's Congress at the fourth session of the 15th Municipal People's Congress held in January this year, and passed by vote after being deliberated twice by the Standing Committee of the Municipal People's Congress. According to the Legislative Affairs Committee of the Standing Committee of the Municipal People's Congress, there are 27 articles in the regulations, which aims to provide necessary conditions and protection for breastfeeding by promoting the government and its departments, medical institutions, public places, employers, social organizations and other subjects.

Working mothers enjoy one hour of breastfeeding time every day

Article 5 of the Regulations stipulates that exclusive breastfeeding shall be promoted in the first six months after the baby is born, except for those who do not meet the conditions for breastfeeding. For infants from six months to 24 months, while supplementing other foods, mothers are encouraged to continue breastfeeding. No unit or individual may interfere with or discriminate against mother's breastfeeding.

For mothers who return to work, the most worry is that they can't insist on breastfeeding at work. How can enterprises guarantee and support breastfeeding? The regulations stipulate that for female employees who breastfeed infants under one year of age, the employer shall arrange one hour of breastfeeding time for them within their daily working hours. If a female worker has multiple births, the breastfeeding time shall be increased by one hour per day for each additional baby. The employer shall treat the nursing time of female employees as normal working hours and pay wages for normal working hours. In addition, if a female employee has actual difficulties when her maternity leave expires, she can apply for breast-feeding leave until the baby is one year old with the approval of the employer. The salary during lactation leave shall be determined by both parties through negotiation.

If the mother and baby room is not built, the maximum penalty is 50000

The implementation of breastfeeding means providing necessary conditions and guarantee for breastfeeding. It is the most urgent to build a mother and baby room to meet the breastfeeding needs of mothers, which is specified in detail in the regulations.

It can be seen from the voted regulations that it is clear that if the construction area of the following public places exceeds 10000 square meters or the daily flow of people exceeds 10000 person times, mother and baby rooms shall be built:

(1) Medical institutions;

(2) Railway stations, rail transit transfer stations, long-distance passenger stations, expressway service areas, airports and other public transport places;

(3) Libraries, museums, cultural centers, art galleries, workers' Cultural Palace, Youth Palace, citizen activity center, women's and children's activity center, stadium, book purchase center and other public cultural and sports service places;

(4) Government service center, convenience service center and other public service institutions;

(5) Comprehensive parks, special parks, scenic spots and other tourism and leisure places;

(6) Business premises.

Medical institutions and pediatric hospitals engaged in midwifery technical services shall build mother and baby rooms.

For newly-built medical institutions and public transport places, the mother and baby room shall be delivered for use at the same time as the main project. If a built public place should be built but no mother and baby room is built, it shall be built again. The regulations also specifically point out that employers with a large number of female employees should build nursing rooms and provide breast milk storage facilities according to the needs of female employees. Encourage the unified construction of nursing rooms in office buildings, industrial parks and other places.

There are also specific requirements for the construction of mother and baby rooms in public places, including independent setting to meet the requirements of ventilation and daylighting. Special nursing chair, baby nursing table, baby safety protection chair and other facilities shall be equipped. Take necessary privacy protection measures in the lactation area. Use materials with energy conservation, environmental protection and safety protection functions. The indication signs shall be standardized, complete, clear and eye-catching, and shall not appear the patterns, words or publicity contents of breast milk substitutes.

The regulations also stipulate that if the construction unit of public places fails to build a mother and baby room in accordance with the regulations, the relevant administrative department shall order it to make corrections within a time limit and impose a warning. If it fails to make corrections within the time limit, it shall be fined not less than 20000 yuan but not more than 50000 yuan.

Financial funds will subsidize the construction of breast milk bank

Liu Xihong, head of the breast milk bank of Guangzhou Women's and children's Medical Center, introduced that breast milk is food and food for normal infants, while for sick children, it is a drug for treatment and rescue, and there are no toxic and side effects. Liu Xihong said that since the establishment of the breast milk bank of Guangzhou Women's and children's center, nearly 450 sick premature infants and critically ill young children have received 'breast milk nutritional treatment', and the youngest beneficiary has only been born for three days. As of August, 25 mother milk banks have been established in China, two of which are in Guangzhou.

In the regulations adopted this time, medical institutions with conditions and needs are also encouraged and supported to set up breast milk banks to collect breast milk from the society for clinical treatment and scientific research for premature infants and seriously ill children in need. Encourage qualified lactating women to donate breast milk to the breast milk bank. Medical institutions shall provide free health examination and safe, hygienic and convenient donation conditions for breast milk donors, and may issue certain nutritional subsidies. The municipal and District People's governments shall provide financial guarantee for the construction, operation and management of breast milk banks.

It is worth noting that in order to regulate the operation of breast milk substitutes, the regulations prohibit medical institutions and their staff from accepting breast milk substitutes provided free of charge by breast milk substitutes manufacturers and operators, or accepting equipment, funds and materials conditionally provided by breast milk substitutes manufacturers and operators for the purpose of marketing. In case of violation, the competent administrative department of public health shall order it to make corrections, confiscate its illegal income and impose a fine of not less than 2000 yuan but not more than 20000 yuan.

If a medical institution provides donated breast milk to a manufacturer or operator of breast milk substitutes, the competent administrative department of health and health shall order it to make corrections and impose a fine of not less than 10000 yuan but not more than 30000 yuan.

Producers and operators of breast milk substitutes shall not provide breast milk substitutes free of charge to medical institutions, or conditionally provide equipment, funds and materials for the purpose of marketing. Manufacturers and operators of breast milk substitutes shall set up prompt words to promote breast feeding or publicize the advantages of breast feeding in the sales area of breast milk substitutes. Producers and operators of breast milk substitutes who violate this clause will be fined not less than 10000 yuan but not more than 50000 yuan.

Specification for breast milk substitutes

It is prohibited for medical institutions and their staff to accept breast milk substitutes provided free of charge by manufacturers and operators of breast milk substitutes, or to accept equipment, funds and materials conditionally provided by manufacturers and operators of breast milk substitutes for the purpose of marketing.

Manufacturers and operators of breast milk substitutes shall not provide breast milk substitutes free of charge to medical institutions, or conditionally provide equipment, funds and materials for the purpose of marketing.
