How to calculate the salary during the Spring Festival overtime?

The Spring Festival holiday in 2018 is arranged to take a 7-day holiday from February 15 to 21, and go to work on February 11 (Sunday) and February 24 (Saturday).

In arranging the work of the laborer in these days, the overtime wage shall be paid at not less than 300% of the daily or hourly wage of the laborer. If overtime work is arranged, workers can be arranged with compensatory leave instead of overtime pay. If compensatory leave is not arranged, overtime pay shall be paid at 200% of their daily or hourly wage.

Payment standard of overtime:

(1) when arranging overtime work on normal working days, the employee shall be paid not less than 150% of his / her own salary.

(2) if it is impossible to arrange workers' work on the rest day and make up the rest time, it shall pay 200% of the normal daily wage to the workers.

(3) if workers are arranged to work on statutory holidays, they shall be paid not less than 300% of their wages.

Overtime provisions

Article 44 of the labor law stipulates that the standard for overtime payment is: if an employee is arranged to extend his / her working time, he / she shall pay not less than 150% of his / her salary; if an employee is arranged to work on a rest day and cannot be arranged to take a rest day, he / she shall pay not less than 200% of his / her salary; if an employee is arranged to work on a statutory leave day, he / she shall pay not less than 300% of his / her salary Of the company.
