Recently, Tianjin No. 3 intermediate people's court made a final judgment on the case of Beijing Zhongde Culture Communication Co., Ltd., Wanda color TV Media Co., Ltd., Xinli Media Group Co., Ltd., Tianjin Jinhu Culture Communication Co., Ltd. and Yue Longgang (stage name Yue Yunpeng) concerning the infringement of the right to adapt the song of peony by the musical work song of the five rings, Reject the claim of the plaintiff Zhongde company.
After hearing, the court held that the song of peony was a cooperative work jointly created by the authors of Ci and Qu, and its copyright belonged to CI author Qiao Yu and Qu authors Lv Yuan and Tang He. The appellant could not exercise the copyright alone.
It is reported that the plaintiff of the case is only Zhongde company authorized by Qiao Yu, the author of the song of peony, and does not involve Lv Yuan and Tang He.
