This revision further tightened the formula registration system, increased the punishment for violations, and made clear the prohibitive provisions on infant formula milk powder in detail.
Disable "zero addition", "imported milk source" and other expressions
The original measures for the administration of formula registration of infant formula milk powder products has been implemented since October 1, 2016. This revision clearly stipulates that if there are animal sources in the name of infant formula milk powder products, the animal sources of raw milk, milk powder, whey (protein) powder and other dairy raw materials used shall be truthfully indicated in the ingredient table according to the product formula. When there are more than two animal sources of dairy raw materials used, the proportion of raw materials from various animal sources shall be indicated.
Those who claim the source of raw milk, raw milk powder and other raw materials shall truthfully indicate the source country and specific source, and it is prohibited to use fuzzy information such as "imported milk source", "from foreign pasture", "ecological pasture", "imported raw materials", "original ecological milk source" and "pollution-free milk source".
The Measures stipulate that the labels and instructions of infant formula milk powder shall not contain the following contents: 1. Disease prevention and treatment functions; Express or imply functional expressions such as benefiting intelligence, increasing resistance or immunity and protecting intestine; For substances that should not be contained or used in the product formula according to the food safety standards, the words "no addition", "no addition" and "zero addition" shall be used to emphasize that they are not used or not contained; False, exaggerated, contrary to scientific principles or absolute contents; Claims inconsistent with the content of product formula registration; Use the image of infants and women, 'human emulsification', 'breastfeeding' or similar terms; Other non-conforming circumstances.
At the same time, it is required to indicate the applicable month age of infant formula milk powder, which can be marked in the way of 'paragraph 1, paragraph 2 and paragraph 3' at the same time. If the formula is involved, it shall be consistent with the content of the registered product formula, and the registration number shall be marked.
Included in the dishonest 'blacklist' and other 7 cases will not be registered
The formula registration of infant formula milk powder products refers to the activity that the State Administration of market supervision and administration reviews the formula of infant formula milk powder products applied for registration and decides whether to approve registration in accordance with the procedures and requirements specified in these measures.
The measures stipulates that in principle, each enterprise shall not exceed 3 formula series and 9 product formulas. Each formula series includes infant formula milk powder (0-6 months old, stage 1), older infant formula milk powder (6-12 months old, stage 2) and infant formula milk powder (12-36 months old, stage 3).
In this revision, seven cases of non registration are proposed, namely, (1) the applicant does not have the R & D capacity, production capacity or inspection capacity suitable for the formula products applied for registration; （2） The registration application materials do not support the scientificity, safety or insufficient basis of the product formula; The contents of the application materials are contradictory and untrue, and do not comply with laws, regulations and national food safety standards; Failing to submit the correction materials within the specified time limit or the correction materials provided do not meet the requirements; （3） The applicant fails to confirm the on-site inspection within the time limit, refuses or fails to cooperate with the on-site inspection; The on-site inspection finds that the application materials are untrue, inconsistent, unable to be traced back or have major defects; Failing to complete the rectification on time; （4） The applicant refuses or does not cooperate with the sampling inspection; The product inspection report is unqualified; The test results show that the determination method is unscientific and cannot be reproduced; （5） There is no obvious difference between the product formula applied for registration by the same enterprise and the product formula applied for at the same age; （6） The applicant is included in the list of serious illegal and dishonest enterprises; （7） Other circumstances that do not meet the registration requirements.
Imported infant milk powder is also applicable
Domestic infant formula milk powder and imported infant formula milk powder shall comply with the formula registration system.
According to the measures, the registration system is applicable to infant formula milk powder products produced, sold and imported in China. The applicant for formula registration shall be a production enterprise that plans to produce and sell infant formula milk powder in China or an overseas production enterprise that plans to export infant formula milk powder to China.
The format of formula registration number of infant formula milk powder product is Guoshi Zhu Zi YP + 4-digit year number + 4-digit sequence number, in which YP represents the formula of infant formula milk powder product. The formula registration certificate of infant formula milk powder is an electronic certificate, which is valid for 5 years.
The measures add provisions that those who alter, resell, lease, lend or transfer the formula registration certificate of infant formula milk powder products shall be fined not less than 10000 yuan but not more than 30000 yuan by the market supervision and administration department above the county level; If a crime is suspected, it shall be transferred to the public security organ and investigated for criminal responsibility according to law.
If an infant formula milk powder production enterprise fails to produce according to the registered formula, the market supervision department at or above the county level shall confiscate the illegal income, illegal products, tools, equipment, raw materials and other articles used for illegal production and operation; If the value of the goods is less than 10000 yuan, a fine of not less than 50000 yuan but not more than 100000 yuan shall be imposed; If the value of goods is more than 10000 yuan, a fine of not less than 10 times but not more than 20 times the value of goods shall also be imposed; If the circumstances are serious, the registration certificate shall be revoked.
