People have to retire when they reach the legal age, which is also expressly stipulated by our country, but the retirement age is different for male and female employees, as well as for the type of work. So how do employees determine the retirement age? What is the retirement age of employees in public institutions?
Identification method of retirement age of employees
When handling the retirement procedures of employees, we often encounter the inconsistency between the records of employees' birth time files and their ID cards, which leads to the problem of determining the standard of employees' retirement age.
Generally, there are four situations in which the birth time records of employees are contradictory to the ID card records: first, when the labor department handles the recruitment procedures, employees adopt false reporting to reduce (increase) their age in order to avoid being too old (too young) and not being employed by the unit; Second, the date of birth is changed in order to achieve the purpose of military service; Third, at the time of initial employment, when employees fill in the time of birth, the Yin and Yang calendars are not divided, resulting in the difference of birth time in months; Fourth, in order to achieve the purpose of early retirement, take other illegal means and other situations that may lead to differences in birth time.
To this end, the state has issued policies and made special provisions. Article 2 of the notice on stopping and correcting problems related to early retirement of enterprise employees in violation of state regulations issued by the Ministry of labor and social security in March 1999 stipulates that the method of combining resident ID card with employee files shall be implemented for the determination of the birth time of employees. When the birth time recorded in my ID card is inconsistent with that recorded in the file, the birth time first recorded in my file shall prevail. It is strictly prohibited to arbitrarily change the birth time of employees and fabricate files. The introduction of this policy has made rigid provisions on the recognition of employees' retirement age. According to this provision, the basic basis for confirming the retirement age of employees is their ID card and personal files. For this provision, some employees do not quite understand and think that the date recorded in the ID card should be their date of birth. As everyone knows, in terms of social reality, there is the possibility of artificial operation of ID card, and there is still the phenomenon of changing and forging ID card. Therefore, the date of birth of employees cannot be completely determined only by ID card. The personal files of employees record their main study resumes, work resumes and all other materials related to social activities. They are historical, continuous and authentic, and are kept by special personnel, which is not easy to tamper with or forge. Therefore, the combination of files and ID cards is more authoritative to determine the birth time of employees.
