Is women's day off?

According to the provisions of the measures for national holidays and memorial days issued by the State Council, women's Day (March 8) is a holiday and memorial day for some citizens, and women have half a day off. In fact, women's Day is not a legal holiday for all citizens. The relevant person in charge of the human social security (inquiry handling) (inquiry handling) (inquiry handling) bureau said that from the perspective of human care, enterprises and institutions try to give half a day off or arrange other activities.

Women's Day is not a holiday overtime?

Women's day should indeed be half a day off; If the unit has a holiday, it shall pay wages and remuneration; If it falls on the rest day of the unit, no compensatory leave will be taken; If the unit does not have a holiday and the employees work normally, it is not overtime and there is no need to pay overtime wages.

Which national festivals and anniversaries will be closed?

The relevant departments of the municipal human resources and Social Security Bureau explained that the national annual festivals and commemorative days can be divided into three categories: holidays for all citizens, holidays and commemorative days for some citizens, and festivals used by ethnic minorities.

The first is the holiday for all citizens. Since 2008, there have been seven national statutory public holidays, namely new year's day, Spring Festival, Qingming, Dragon Boat Festival, labor day, Mid Autumn Festival and national day, with a total of 11 days.

There are three principles for the treatment of employees on public holidays. The first is the salary that should be paid during the holiday. The second is that overtime pay should be paid at work. If a worker is arranged to work on statutory holidays, the salary shall be paid at not less than 300% of the worker's daily or hourly wage standard. Third, if it falls on Saturday or Sunday, it should take a supplementary leave on a working day. The holidays of national public holidays are centralized by adjusting the two-day weekend, and the leave period is issued by the State Council every year.

The second category is the holidays and commemorative days for some citizens, including women's Day (half a day for women on March 8), Youth Day (half a day for youth over the age of 14 and under the age of 28 on May 4), children's Day (one day for children under the age of 14 on June 1), and the anniversary of the founding of the Chinese people's Liberation Army (half a day for active servicemen on August 1).

As for the half day holiday time, it is not mandatory to specify whether it is morning or afternoon, which can be determined by each unit according to the specific situation. In addition, other festivals and anniversaries, such as the February 7th anniversary, the May 30th anniversary, the July 7th anniversary of the war of resistance against Japan, the September 3rd anniversary of the victory of the war of resistance against Japan, the September 18th anniversary, teachers' day, nurses' day, reporters' day and tree planting day, will not be closed.

There are also three principles for the treatment of employees during the holidays of some citizens. The first is the salary that should be paid during the holiday. Article 51 of the labor law clearly stipulates that the employing unit shall pay wages according to law during the statutory leave of workers. The second is that there is no need to pay overtime pay for work. The letter of the general office of the Ministry of labor and social security on salary issues related to some citizens' holidays stipulates: "during the holidays of some citizens, the unit shall pay wages to employees who participate in social or unit organized celebrations and work as usual, but shall not pay overtime wages." Third, if it falls on Saturday or Sunday, there is no compensatory leave. This is also clearly stipulated in the above documents.

The third category is the festivals used by ethnic minorities. The local people's governments in areas where ethnic minorities live in concentrated communities shall, in accordance with the customs of ethnic minorities, set holiday dates.

2019 national festival and anniversary holiday arrangements

Article 3 festivals and anniversaries for some citizens:

(1) Women's Day (March 8), half a day off for women;

(2) Youth Day (May 4), a half day holiday for young people over the age of 14;

(3) Children's Day (June 1), children under the age of 13 have a day off;

(4) On the anniversary of the founding of the Chinese people's Liberation Army (August 1), active servicemen have a half day holiday.

Article 4 the local people's governments in areas where ethnic minorities live in concentrated communities shall, in accordance with the customs of their respective ethnic groups, set holiday dates for festivals in the habits of ethnic minorities.

Article 5 there shall be no holidays on the 27th anniversary, the 30th anniversary, the 77th anniversary of the war of resistance against Japan, the 93rd anniversary of the victory of the war of resistance against Japan, the September 18th anniversary, teachers' day, nurses' day, journalists' day, tree planting day and other festivals and anniversaries.

Article 6 if a holiday falls on a Saturday or Sunday, all citizens shall take a supplementary holiday on a working day. If the holidays of some citizens fall on Saturday or Sunday, they will not be made up.
