On May 22, the Ministry of transport issued the guidance on encouraging and regulating the development of Internet rental bicycles (Draft for comments) (referred to as the guidance) for two weeks.

Scientific orientation encourages development

Internet rental bicycle (commonly known as "shared bicycle") is a time-sharing rental operation of non motor vehicles. It is a new service mode for the integrated development of mobile Internet and rental bicycle. It is an integral part of the city's green transportation system and an important way to facilitate public short-distance travel and public transport transfer.

The guiding opinions make it clear that urban people's government is the main body responsible for the management of Internet rental bicycles, and should adhere to the basic principles of 'service-oriented, reform and innovation, standardized and orderly, territorial management, and multi-party co governance' to encourage and standardize development. All localities should give priority to the development of public transport, make slow traffic planning in combination with the characteristics of the city, and develop Internet rental bicycles as a whole, but do not encourage the development of Internet rental e-bikes.

Orderly delivery and reasonable layout

In view of the issue of vehicle delivery, the guidance requires cities to study and establish vehicle delivery mechanism according to the characteristics of cities, public travel needs and the development orientation of Internet rental bicycles, so as to guide operating enterprises to reasonably and orderly deliver vehicles.

In order to solve the problems of driving and parking at random, the guiding opinions require cities to reasonably arrange bicycle traffic network and parking facilities, promote the construction of bicycle lanes, standardize the setting of parking spots, make a negative list of areas and sections that are not suitable for parking and implement the management of no parking, and plan supporting bicycle parking spots for key urban areas.

Clarify the main responsibility of enterprises and encourage them to provide services free of deposit

The guidance requires operating enterprises to strengthen the construction of online and offline service capacity, reasonably allocate offline service teams, and strengthen vehicle scheduling, parking and maintenance management. It is required to register and use the real name system of users, prohibit providing services to children under 12 years old, purchase personal accident insurance and third party liability insurance for users, and promote the use of electronic fence and other technologies.

The guidance encourages Internet rental bike operators to provide rental services in a deposit free manner. Enterprises that collect deposits and prepay funds from users shall use the funds exclusively, accept supervision, establish and improve the return system of user deposits, and actively implement the modes of "rent as you go, return as you go".

Strengthen credit management of safe and civilized vehicles

The guiding opinions put forward that we should guide users to use their bicycles safely and civilly, and strengthen the publicity and education on the use norms of Internet rental bicycles and safe and civilized riding. Strengthen the credit management, establish the basic database of enterprises and users' credit, record the uncivilized behaviors and illegal behaviors of enterprises and users in the credit records, and establish the mechanism of Credit Incentive and punishment for dishonesty.

The guiding opinions encourages the public to participate in the governance, and forms a social governance system of enterprise subject, government supervision and multi participation. We will increase the protection of consumers' rights and interests and prevent the transfer of business risks to consumers.
