Is the doctor-patient relationship so tense now

Now the relationship between doctors and patients is really tense. It's easy for the patients in the hospital to beat the doctors. Nowadays, doctors are not easy to be. Their lives are always in danger. Under such circumstances, can the family members of patients understand and support more~

Family members are dissatisfied with beating doctors

At noon on May 18, 2016, Yang Shaoping, a villager of Quanshui village, Shaodong county, Shaoyang City, had a traffic accident, which injured his wife and three children. The injured were immediately sent to the people's Hospital of Shaodong county for treatment. Doctors on duty Zeng Peirong, Deng Youlin and Wang Jun were responsible for the diagnosis and treatment of the injured. Shortly after the injured were sent to hospital, three relatives of Yang Shaoping, Yang Hailei, Yang Xinchun and Yang Li, rushed to the hospital.

Shaoyang City Health and Family Planning Commission of the situation shows that there are two boys among the injured, two and four years old respectively. At 12:43 on the day of the incident, they were received by Deng Youlin and Zeng Peirong respectively. When they received the treatment, they were conscious. Only the facial part was blue and purple, and they did not need debridement, so they were given head CT examination. At 13:40 on the same day, the two completed head CT examination and returned to the ward. The family members thought that debridement should be carried out immediately for the two children, so they found Doctor Wang Jun.

Witnesses reported that Wang Jun was undergoing surgery at that time, and his family members asked him to stop the surgery and debridement for their children. Wang Jun told them, "the child's condition is not serious. Even if we have to have an operation, we have to wait until the operation is over. "But Yang Lixin thought that the hospital didn't give timely treatment to the child. He made a lot of noise in the hospital and quarreled with Wang Jun. Yang Xinchun embraces Wang Jun with both hands, Yang Lixin hits Wang Jun with one punch on the head, and Yang Hailei hits Wang Jun with two or three punches on the left chest. Wang Jun was immediately knocked down, head hit the ground, but also rebounded.

Witnesses said that Wang Jun lost consciousness, stopped breathing, and was incontinent. After hearing the news, the hospital medical staff immediately rescued him. Later, due to his serious injury, Wang Jun died at 17:15 on May 18.

The reporter learned that Wang Jun, then 40, was the only child in his family. After graduating from Hengyang Medical College, he had worked in Shaodong people's Hospital for 18 years. In the view of colleagues, Wang Jun is kind, patient and meticulous, and his family is also very complete. Wang Jun's wife is a teacher. They have a son and a daughter. At the time of the incident, his youngest son was just 10 months old.

On the evening of May 18, 2016, the Hunan Provincial Public Security Bureau informed that after the incident, the Shaodong County Public Security Bureau immediately launched a major criminal case emergency plan. More than 50 capable police officers were deployed to launch the detection and arrest work, arrested the suspect Yang Xin Chun and Yang Lixin, and at 19 o'clock in May 18th, another suspect Yang Hailei surrendered himself under pressure.

After the case, the Supreme People's Procuratorate strengthened its guidance, and Shaodong county people's Procuratorate intervened in the investigation in advance to guide the evidence collection. On May 19, 2016, the Supreme People's Procuratorate arrested three people, including Yang Hailei, on suspicion of intentional injury. According to the relevant jurisdiction provisions, on October 14, the case was initiated by Shaoyang people's Procuratorate.

On January 20, 2017, Shaoyang intermediate people's court sentenced Yang Hailei to 12 years' imprisonment and deprivation of political rights for the crime of intentional injury, Yang Lixin to eight years' imprisonment and Yang Xinchun to four years' imprisonment.

Shaoyang people's Procuratorate held that Yang Hailei's sentence was too light, and filed a protest on February 3, 2017. Recently, the provincial high court heard the case in Shaodong county court.

Li Jian, a lawyer from Hunan Wanhe united law firm, said that according to Article 234 of the criminal law, anyone who intentionally injures and causes death shall be sentenced to fixed-term imprisonment of more than 10 years, life imprisonment or death penalty. According to this article, death caused by intentional injury is punishable by death.

Li Jian said that in this case, due to the intentional injury of Yang Hailei and other three people, the victim Wang Jun died of invalid rescue. China's "criminal law" stipulates the principle of crime adaptation, that is, the severity of punishment should be adapted to the crime committed by criminals and the criminal responsibility they bear. Yang Hailei, who had the highest sentence in the first instance judgment, was sentenced to 12 years' imprisonment. Although it was within the range of sentencing, combined with the serious consequences of the death of the victim Wang Jun, Shaoyang people's Procuratorate has a law to follow in lodging a protest.

Less "silent law enforcement" against "medical trouble"

The recent incidents of "killing doctors" and "medical trouble" have aroused heated discussion among the representatives here. Chen Jie, deputy to the Municipal People's Congress, is concerned about lax law enforcement. She said, is there any difference between the doctor-patient relationship and the ordinary citizen relationship? When two citizens fight, the police will arrive, but the patients put up a mourning hall in the hospital and block the access to the hospital. When the police arrive, they don't stop it in time because they disturb the public order. Instead, they are 'silent law enforcement' at the scene. Isn't the law enforcement lax?

This view was seconded by many deputies to the National People's Congress. Ji Zhiyong, deputy to the Municipal People's Congress, said, "where did the government and the law go when the 'medical trouble' dispute appeared? Beating doctors, according to China's" law on public security management and punishment ", those who disturb public order, if the circumstances are serious, can be detained for 5 to 10 days. If the law enforcement is strict, I believe it can achieve the same obvious effect as the current 'no driving after drinking'.

Strengthen the design of medical system to avoid disputes

At the same time, Chen Jie suggested strengthening the system design to avoid unnecessary disputes. A 70 year old community resident reported that he went to the health care office next to the Shenzhen People's Hospital for physical examination. After waiting in line for a long time, he encountered someone jumping in the queue. The resident said that "he wanted to hit his heart at that time.". In such cases, it is suggested that the health care office should adopt a district system to avoid unnecessary conflicts and disputes as far as possible. 'she said.

Han Wei, deputy to the Municipal People's Congress, said that the doctor-patient relationship is actually a problem of social trust, which needs to mobilize the enthusiasm of all parties. She said that there was no progress in resource sharing in Shenzhen's public hospitals, and the hospitals themselves were not active. As a result, patients were constantly discharged first, repeated examinations, and then transferred to other hospitals. They had to find acquaintances every time, and the people complained a lot. She suggested that while improving the treatment of doctors, training and supervision of doctors should be carried out, professional ethics should be strictly observed, and the assessment of doctors should be enhanced by "evaluation by patients and residents".

In addition, Han Wei suggested that we should first sort out the problems and find out the path. We can first issue the 'government order' and quickly formulate the government rules and regulations to be ahead of the country.

Current situation of doctors and patients

The medical trouble is on the rise

The person in charge of the Public Security Department of the Municipal Public Security Bureau disclosed that in recent years, the difficulty and complexity of the medical disputes in Shenzhen have been on the rise. Some branches have reported that they have to deal with the medical disputes with hundreds of people every month, and there is a small dispute almost every three days. In this regard, she suggested that the hospital should strengthen the investment in monitoring public security facilities, improve security training and prevention, and strengthen the quality of video evidence collection. The hospital should first do a good job in safety 'self-protection'.

Guo Yongzhong, President of the civil trial division of the Municipal People's court, said that attacks on judges and legal staff often occur, and the court has established a prevention mechanism for this. When it finds signs of conflict, it will draw attention to the security, and it is suggested that the hospital also establish an effective prevention mechanism. At the same time, he also suggested that hospitals should improve their medical professional level. "At present, the Municipal Intermediate People's Hospital handles dozens of cases of medical damage disputes every year, but many hospitals have insufficient outpatient records before. Once something happens, they temporarily supplement the outpatient records. From the legal point of view, it shows that the hospital has problems, and the hospital should pay more attention to them. "At the same time, the intervention of experts is helpful to mediation, and the effect is better," he said. The Municipal Intermediate People's hospital is preparing to set up a 'medical expert database' to solve the problem of duplicate medical identification.

Quan Xiaolin, deputy director of the public relations department of the Municipal People's Procuratorate, said that the Municipal People's Procuratorate had implemented a "quick arrest" procedure for medical disturbances and other incidents to increase its deterrent power. She suggested that "we should create a harmonious environment with reform thinking, strengthen the precision of hierarchical medical reform, and maintain medical order with legal thinking.". Let emotion belong to emotion, morality to morality and law to law '.
